Trust Funding in Texas: The Step That Makes Your Trust Work

The most expensive mistake in Texas estate planning is a signed, notarized, beautifully drafted Revocable Living Trust that was never funded. Funding is what turns paper into a plan.

What funding actually means

Funding is retitling your assets into the name of your trust — moving legal ownership from you individually into you as trustee. A Texas home moves by a General Warranty Deed conveying to the trust and a Designation of Homestead. Bank and brokerage accounts move by presenting a Certification of Trust to the institution and completing their retitling forms.

The Texas homestead nuance

Texas homestead protection is one of the strongest asset-protection features in American law. When you retitle your Texas homestead into a Revocable Living Trust, homestead protection generally continues — but the trust must be structured correctly and the Designation of Homestead should be recorded. Doing this wrong can inadvertently jeopardize protection that is otherwise absolute.

  • Retirement accounts (IRA / 401(k)) — DO NOT retitle; update the beneficiary designation only, and consider stretch and SECURE Act constraints
  • Vehicles and tangible personal property — typically remain outside the trust and pass under the pour-over will
